ஆபாச ஆடை - குற்றவாளி விடுதலை?

பிரித்தானியாவில்... 10 வயது சிறுமியை பூங்கா ஒன்றில் பாலியல் வல்லுறவு கொண்ட 24 வயது வாலிபர் இன்னும் சில மாதங்களில் விடுதலை ஆகவுள்ளார். (லண்டனில கூட பூங்காக்கள் தான் பாலியல் களியாட்ட இடங்கள். தமிழர் வாரிசுகளும் இதில் குறை வைக்கிறதில்ல). அவரின் விடுதலைக்கான காரணம்.. குறித்த சிறுமி ஆபாசமாக ஆடை அணிந்திருந்தது தவறான நடவடிக்கைக்கான தூண்டுதல் என்ற வகையில் அமைந்துள்ளது.!

பிரித்தானியா உட்பட மேற்குலகில் இருந்து உலகம் பூராவும் பெண்கள் ஆபாசமாக ஆடை அணிவது நாகரிகமாக வளர்க்கப்பட்டு வருவது இந்தத் தீர்ப்பின் மூலம் பெண்கள் மீதான ஆண்களின் வன்முறைகளை நியாயப்படுத்த வாய்ப்பை உண்டு பண்ணியுள்ளது..! இது ஒரு ஆபத்தான சூழலை பெண்களுக்கு உருவாக்கும். அவர்கள் எங்க சிந்திக்கப்ப் போகிறார்கள்...! அதுதானே பாலியல் சுதந்திரம் வேணும் என்று பிளிறிகிறார்கள்..! இப்படித் திரிஞ்சே தொலைஞ்சு போகட்டும்.

Law chief to probe 'lenient' rape sentence

The Attorney General is considering appealing against a sentence given to a window cleaner for raping a 10-year-old girl.
Keith Fenn, 24, was given concurrent two-year and 18-month jail sentences at Oxford Crown Court by Judge Julian Hall for two attacks on the girl in a park.
Because of the amount of time he has already spent in prison awaiting sentence, Fenn could be free in a few months time.

The sentence was condemned by one MP s "pathetically lenient".
The Attorney General Lord Goldsmith acted after Tory backbencher Mike Penning wrote to him protesting about Fenn's treatment.
A spokesman for Lord Goldsmith said: "He has asked for the papers from the CPS so he can consider whether or not to refer the sentence to the Court of Appeal as unduly lenient."

A man who raped a ten-year-old girl will be free in four months after the judge said the victim "dressed provocatively".
Keith Fenn, 25, admitted having sex with the girl, who claimed to be 16, twice in a park after meeting her in the street in Henley-on-Thames, Oxfordshire.
Judge Julian Hall – who a few months ago told a paedophile to buy his six-year- old victim a bicycle – said the girl dressed in a frilly bra and thong.

"Did she look ten? Certainly not," he added.
The victim, who had been in care since the age of four, regularly wore make-up, strappy tops and jeans, Oxford Crown Court heard.

Judge Hall said: "Here is a very young woman who is taken to the park. Within three-quarters of an hour of meeting a 24-year-old man, they have sex."
Fenn, of Oxford, said finding out her age was "a shock".
He was sentenced to two years but will be free soon, after spending eight months in custody.

He was placed on the sex offenders' register for ten years.
In law, a girl under 13 cannot consent to sex.
The NSPCC said: "There is no excuse for having sex with a ten-yearold, no matter how she dresses."

Children's charities have reacted with anger after a window cleaner who raped a girl of 10 was jailed for two years.

The charity Kidscape accused Judge Julian Hall of "trying to find excuses" and said a child must never be blamed.

Attorney General Lord Goldsmith is to decide whether the sentence should be appealed against as "unduly lenient".

Moral dilemma
Oxford Crown Court heard that Fenn raped the girl in a park on 14 October, before an accomplice, Darren Wright, 34, took her home and sexually assaulted her.
Judge Hall said in sentencing he faced a moral dilemma as the fact they had sex within 45 minutes of meeting was an absolute crime.

But he said the girl had dressed provocatively and looked as though she was 16.
Lawyers for the defendants stressed that the sex had been consensual, and was only termed 'rape' because of the framework of law.

They said the judge stated that doctors who examined the girl believed she was in her mid-teens and she was treated by most people as older than her actual age.
The judge gave Fenn concurrent two-year and 18-month sentences, but he will be free in eight weeks after serving eight months in prison awaiting sentence.
Wright is already free as Judge Hall had already given him a nine-month sentence for inciting the girl to perform a sex act.

'Back to the 1950s'
Dr Michele Elliott, director of Kidscape said the decision had left her "lost for words".
She said: "It takes us back to the 1950s when the victim was blamed if they were dressed provocatively.
"No-one in my opinion could mistake a 10-year-old child, even dressed up, for a 16-year-old. They are just trying very hard to find excuses.
"You can never blame a child victim for sexual abuse when excusing the abuser of any kind of abuse."

The NSPCC added: "There is no excuse for having sex with a 10-year-old, no matter how she dresses."

A spokesman for Lord Goldsmith said he had asked the Crown Prosecution Service to send him the papers on the case, and would consider whether or not to refer the sentence to the Court of Appeal as "unduly lenient".
He has 28 days to make a decision.
